Please review these policies carefully as they are the terms of sale that govern your purchases at the Nexco Store. They set out your rights and obligations with respect to your purchases, including important limitations and exclusions, such as those in Nexco's product / services warranties. Your placement of an order at the Nexco Store constitutes your agreement that these policies apply to the order, so be certain you understand them before you place your order.

For order status information on an order you already placed with the Nexco Store, please visit nexco.com and login with your store account. In the bottom right of the screen click the "Order History" link to visit your personalized order tracking page.
Sales to End Users Only:
The Nexco Store sells and ships products and or services to end user customers only. You may not purchase for resale. Nexco reserves the right to refuse or cancel your order if Nexco suspects you are purchasing for resale. If you wish to resell Nexco products, a reseller relationship must be set up by contacting Nexco Business Development. Visit the Contact Us page for contact details.
Sales to U.S. and Other Countries:
Nexco sells to U.S. clients as well as to clients in many countries throughout the world. Nexco reserves the right to prevent access to the Nexco Store from any IP address or location suspected of illegal activities or listed in U.S. State Department travel warnings or U.S. Treasury sanctions summaries.
Proof of Purchase:
Nexco will email you a confirmation of your order upon the successful charging of your credit card for your store purchase.
Nexco offers certain products and or services that may be custom-configured to your specifications. Please review your order carefully. Once your custom-configured item has been prepared for shipment, it cannot be changed or canceled. In the case of custom-configured services, if those services have not yet been rendered, there may be cases where a refund can be provided. See the returns & refunds policy below for details.
Payment Methods:
Nexco allows you to make your purchases using any of the payment methods described below. Please read our policies carefully.
Credit, Debit, and Check Cards
The Nexco Store accepts credit cards via direct payment online or via call-in phone orders. Whether you order online or by phone your order to Nexco may be paid by credit, debit, or check card. When you provide Nexco with your card information, Nexco will obtain a pre-approval from the card company for the amount of the order, which may result in a corresponding block on your available credit while the pre-approval remains in place. For professional services, Nexco will bill your credit card and process your transaction under your debit or check card immediately upon completing the Nexco Store checkout process. For products that require shipping, Nexco will not charge your card until the item has shipped.
The Nexco Store accepts American Express, Discover, MasterCard, and Visa credit, debit, or check cards associated with a billing address within the 50 United States and the following U.S. territories:

Debit cards and check cards have daily spending limits that may substantially delay the processing of your order. Payments via American Express require five business days to clear before Nexco services can begin.
The Nexco Store requires the credit, debit, or check card security code for your card for any telephone or online purchase to protect against the unauthorized use of your credit card by other persons. The security code is an individual three- or four-digit number specific to your card that may be printed on the face of your card above the embossed account number (if American Express), or on the back of your card, on the signature panel (if Visa, MasterCard, or Discover).
Cashier's Check or Money Order
The Nexco Store accepts cashier's checks and money orders as valid forms of payment. Personal or business checks are not accepted. If you wish to pay by cashier's check or money order, you must order by phone. Visit the Contact Us page for contact details. The cashier's check or money order must be made payable to Nexco, Inc. Please ensure that you include your Order Number that was given to you by our Nexco tele-sales rep at the time of your order. Nexco must receive your payment within 10 calendar days or your order will be canceled. Please allow one business day for order processing after Nexco receives your payment.
Wire Transfer
The Nexco Store accepts bank wire transfers as a valid form of payment. If you would like to use a wire transfer to pay for your order, please follow these steps:
• Contact the Nexco Store customer service and place your order by phone. Visit the Contact Us page for contact details.
• Obtain the final dollar total of your order including tax and any applicable shipping charges from the Nexco tele-sales rep.
• Have your bank electronically transfer the total dollar amount of your order.
• Reference your Order Number in your wire payment instructions. Please contact us for wire instruction details.
Please allow one business day for the processing of your wire transfer.
Sales Tax:
Non-shippable services such as: Nexco Professional Services, hourly fees, domain name registrations, Web hosting and other services for hire are not subject to sales tax.
However, if you purchase a shippable product, Nexco will charge you sales tax based on your shipping address and the sales tax rate in effect at the time your order is billed. If you phone in your order, the Nexco tele-sales rep will provide an estimated dollar total of your order including tax and any applicable shipping charges at the time you place your order. If the sales tax rate for the state to which your order is being shipped changes before the product is shipped, the rate in effect at the time your order is invoiced will apply. The proof of purchase that Nexco mails to you will include any applicable sales tax as required.
Shipping Options:
If your product is shippable, Nexco offers tiered shipping options through the US Postal Service, UPS and Federal Express. You choose the shipping option that is best for you at the time of checkout. USPS, UPS and Federal Express offer direct tracking of your package on their respective Websites.
Delivery estimates by shipping vendors and are not controlled by Nexco. Delivery of your order is beyond Nexco's control once your order leaves Nexco's facilities. Nexco cannot assume liability for late deliveries, regardless of the delivery method you specify.
Order Processing:
Nexco will begin payment processing for shippable orders placed on weekends or holidays on the next business day. Business days are Monday - Friday, excluding federal holidays. Professional Services are charged in full at the time of check out from the Nexco Store.
Prices:
The Nexco Store offers many levels of discounting bundles and coupons to ensure that our pricing remains competitive. Nexco reserves the right to change prices for products and services in the Nexco Store at any time and particularly to correct pricing errors.
Product Availability:
Nexco makes every effort to ship your product or start your services according to the estimated lead times provided to you. Although Nexco makes every effort to ship your order or start your services according to the lead time provided, these dates may change due to changes in supply or staffing. If the lead time changes, Nexco will contact you via email and provide a revised estimate.

Nexco reserves the right to change quantities of items or services available for purchase at any time. Though Nexco makes every effort to supply you with the products and services you order, there may be times when Nexco confirms orders but later learns that it cannot supply the ordered products or services, either at all, in the quantities ordered or within the timeframe discussed.
Cases where Nexco may not be able to provide products or services ordered include: when Nexco learns that a shippable product or service is no longer being manufactured or offered or otherwise becomes unavailable to Nexco, when Nexco cannot source the staffing for the services you ordered, or when there was a pricing error in the Nexco Store when you ordered. In those cases, Nexco will contact you to inform you about alternative options or rescheduling of your services. If you do not wish to move forward with alternate plans or products that are available, Nexco will cancel your order for the products or services that Nexco cannot supply, and refund your purchase price for those products or services.
Product Warranty:
Before you purchase Nexco branded professional services you may review a copy of the limited warranty on Nexco services, including limitations and exclusions, by reading the Nexco Master Services Agreement (MSA).
By making a purchase at the Nexco Store, whether you place your order online or by telephone, you acknowledge that you have had an opportunity to review the Nexco MSA and have done so to the degree you need to be familiar with the agreement, and that you accept the MSA terms and conditions, including the limitations, exclusions, and disclaimers contained therein.
Non-Nexco branded, third-party products are, to the greatest extent permitted by law, sold "AS IS" by the Nexco Store, but may be accompanied by their manufacturers' standard warranties. Nexco sells "AS IS" products as is, where is, and with all faults, and without express or implied warranties from Nexco. If you have questions about manufacturers' warranties that accompany such products, please see the product description page or Contact Us.
Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the disclaimers, exclusions or limitations may not apply to you, and you might have additional rights.
Products sold through the Nexco Store that do not bear the Nexco brand name are not automatically supported by Nexco. Additional fees may apply. If you do not elect to have Nexco support your non-Nexco branded products and or services then those items are serviced and supported exclusively by their manufacturers or providers in accordance with any terms and conditions packaged with the products. Nexco's Limited Warranty within the MSA does not apply to products that are non-Nexco branded, even if bundled or sold along side with Nexco products. Please contact the manufacturer or provider directly for technical support and customer service in this case.
Return and Refund Policy:

Please note that Nexco does not permit the return of or offer refunds for the following products and/or services:
• Professional Services hours that have already been completed.
• Professional Services hours that have already been committed to and paid in advance to ensure staffing levels for the client's services; examples of this would be the current month's fee for the Nexco FlexWeb program and any FlexWeb rollover hours.
• Third Party Services and or products purchased on the client's behalf that do not offer refunds to Nexco; examples would be: domain name registrations, Web hosting services, SSL certificates, PCI security scanning, search engine blasts, press release distributions, pay per click advertising, and more.
• Technical Support Services.
• Support Materials purchased on the client's behalf; examples would be: office supplies, hardware, software & templates, memberships, online services, presentation materials and more.
• Telephone and Internet fees.
• Travel Expenses.
• Personalized Items required for client's services.
If a qualified product or service (or the remaining portion of the qualified product or service) does not meet with your full satisfaction you may return it to Nexco or cancel it within 30 calendar days of the purchase date for a refund of the unused portion of the service or product that Nexco has not already completed payment for. The refund may take the form of either a Nexco Store credit, a check made out to you or a credit back to the credit card you used for your initial purchase.
Items / services cannot be returned or refunded past 30 calendar days from the initial purchase date.
The Nexco refund policy only relates to the product or service purchased from the Nexco Store. The refund policy does not cover the deliverables that are the result or work product of executing services you have purchased. Nexco's refund options for qualified products or services only relate to the unused portions of products and or services from your order that have not been already paid for by Nexco. For details related to work product or related deliverables that do not meet your approval, refer to the Nexco Master Services Agreement, Section 4.
Other Terms and Conditions:
Nexco is not responsible for typographical errors. Nexco reserves the right to cancel any order you have placed if there was a typographical error on the Nexco Store concerning the pricing or availability of any item you ordered when you placed the order.
Nexco reserves the right to change the terms and conditions of sale at the Nexco Store at any time.
Nexco may make changes to any products or services offered at the Nexco Store, or to the applicable prices for any such products or services, at any time, without notice. The information provided at the Nexco Store with respect to products and services may be out of date, and Nexco makes no commitment to update the information provided at the Nexco Store with respect to such products and services.
Nexco reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Nexco Store, or to any portion of the Nexco Store, for any reason; (2) to modify or change the Nexco Store, or any portion of the Nexco Store, and any applicable policies, terms, promotions and/or offers; and (3) to interrupt the operation of the Nexco Store, or any portion of the Nexco Store, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
To the extent permitted by law, all sales at the Nexco Store are governed by California law, without giving effect to its conflict of law provisions.
No Nexco employee or agent has the authority to vary any of the Nexco Store's policies or the terms and conditions governing any sale.
FlexWeb Referral Rewards are available to US customers only, as allowed by law. Rewards at certain levels may require Nexco to issue you an annual Federal tax form 1099.
If any of the aforementioned policies are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such policy shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of the policy, so that the policies shall remain in full force and effect.
Nexco's failure to insist on or enforce strict performance of these policies shall not be construed as a waiver by Nexco of any provision or any right it has to enforce these policies, nor shall any course of conduct between Nexco and you or any other party be deemed to modify any provision of these policies.
These policies shall not be interpreted or construed to confer any rights or remedies on any third parties.
